Home Slicker^® 50-Year Limited Warranty

Benjamin Obdyke Incorporated (“Benjamin Obdyke”), warrants to you, the original owner of its Home Slicker®, Home Slicker® Plus Typar® , Home Slicker 10®, Home Slicker 10 Plus Typar® , and Mortairvent® sidewall rainscreen products (collectively “Home Slicker”), that Home Slicker, when installed in conjunction with new siding and in accordance with Benjamin Obdyke’s published installation instructions, is free from manufacturing defects for fifty (50) years after the date of installation when the new siding installed with Home Slicker is warranted for fifty (50) years by the siding manufacturer, or for such shorter period of time based on the warranty period of the new siding if less than fifty (50) years.

The warranty is valid only when Home Slicker is installed, finished and maintained according to Benjamin Obdyke’s written installation instructions. This warranty does not cover damage of any kind resulting from improper use, improper installation, or fire, flood, earthquake, storm, tornado, or other acts of God, structural shrinkage or distortion of the sidewall or materials to which Home Slicker is applied, deterioration of the siding, exposure to harmful materials or chemicals directly applied or in the atmosphere (including, but not limited to salt spray and acid rain), or any other cause beyond the control of Benjamin Obdyke. The warranty is nontransferable.

Benjamin Obdyke’s warranty is expressly limited to the following: (a) the owner, at the time of initial installation of Home Slicker, of an owner occupied single family residence, residential condominium, residential planned community unit, residential cooperative, residential town home or residential row home (collectively “Residence”); (b) the initial owner occupant of a newly constructed Residence constructed with Home Slicker; (c) the owner, at the time of initial installation of Home Slicker of an owner occupied stand alone commercial building; or (d) the initial owner occupant of a newly constructed stand alone commercial building constructed with Home Slicker. Other applications may be covered with written approval provided by Benjamin Obdyke. The warranty is nontransferable.

Claims under this warranty must be made in writing to Benjamin Obdyke within the applicable warranty period and within thirty (30) days after the discovery of the defect. Such claims must refer to date of purchase and the installer’s name and address. Claims should be addressed to: Benjamin Obdyke Incorporated, Attention: Customer Service, 400 Babylon Road, Suite A, Horsham, PA 19044. Benjamin Obdyke shall have a reasonable opportunity to inspect the Home Slicker involved for defects before repairs are begun. If the Home Slicker contains a defect covered by this warranty,
Benjamin Obdyke, at its sole discretion, will either, (a) pay for the cost of materials to repair or replace the Home Slicker, (b) provide a replacement sidewall rainscreen product of equal quality or value as a substitute, or (c) refund the original purchase price of the Home Slicker. In no event shall Benjamin Obdyke be obligated to pay for the cost of labor for such repair or maintenance.

Benjamin Obdyke Incorporated makes no express warranties except such as set forth herein. The remedies provided in the above express limited warranty are the sole and exclusive remedies available to you. No other express warranties are made. Benjamin Obdyke’s complete liability and the owner’s exclusive remedy are limited to repair, replacement or refund on the basis stated herein. ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR USE, ARE LIMITED IN DURATION AS SET FORTH ABOVE. In no event shall Benjamin Obdyke Incorporated be liable for any incidental, special or consequential damages. Some states do not allow limitations on how long an implied warranty lasts or do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you.

This warranty shall not apply to Home Slicker sold outside of the United States or Canada. This warranty gives you specific legal rights, and you may have other rights that vary from state to state.
